DEVELOPMENT OF THE INSTITUTE OF HAVING TO DO WITH A CRIME: CRIMINALISATION AND HUMANISATION ISSUES

Abstract:
The article analyses topical problems in the criminal law regulation of liability for having to do with a crime under Russian law. The authors note a tendency towards the expansion of this institution, while also critically evaluating the acting legal norms. The focus is on debated issues such as the need to discern liability depending on the stage of the principal crime commission, as well as the feasibility of criminalizing of non-reporting of an acknowledged innocence of a person. A significant part of the research is dedicated to the suggestion to expand the scope of individuals who are not criminally liable for non-reporting of a crime or for concealment of a crime. The issue of including persons in de facto marital relationships, half-siblings (having a common father or mother), as well as lawyers, doctors, psychologists, and clergy, is being presented for consideration. The authors argue for the need to introduce corresponding amendments to the notes to Art. 2056 and 316 of the Criminal Code of the Russian Federation in order to implement the principles of justice, humanism, and legal certainty.
