ON THE CONCEPT OF INTERNATIONAL COOPERATION IN CRIMINAL PROCEEDING

Abstract:
The article considers the concept of international cooperation in criminal proceeding. The author considers that even amid the complex international environment it is necessary to enable cooperation with foreign powers to counteract crime, inter alia, in criminal proceeding. It is noted that nowadays in criminal procedural legislation of the Russian Federation there is no legal definition of the indicated activity. Various definitions of international cooperation in criminal procedure developed by legal scholars and having doctrinal character are analysed in the paper. The authors point out the difference of scholars' approaches towards understanding the concept of international cooperation in criminal proceeding resulting in different views on both some aspects of the activity and its general notion. The emphasis is made on the difference of various scholars' approaches towards the definition of international criminal procedural cooperation. The author methodically formulates the components of the scientific definition of international criminal procedural cooperation. In conclusion, he suggests his own definition of cooperation of criminal proceeding participants with the competent bodies and authorities of foreign powers.
