Существующий ныне алгоритм уголовного судопроизводства (процесс познания от преступления к приговору и соответствующие ему процедуры) — творение века двадцатого, а во многом и вовсе девятнадцатого. Вместе с тем очевидно, что общество в своем развитии все эти две сотни лет на одном месте не стояло. Следовательно, новые производительные силы (средства производства) с неизбежностью породили новые производственные отношения, в первую очередь кадры, владеющие технологиями XIX в. Поэтому неудивительно, что на смену традиционным для прошлых веков сугубо «материальным» офисам полиции, прокуратуры и суда, а равно и привычно подшитым «бумажным» делам в XXI в. с неизбежностью приходит не просто новое, а что-то абсолютно новое — инновационное: «виртуальный» офис и «виртуальное» дело. Появятся также и соответствующие новой правой культуре методы функционирования уголовно-правовых и уголовно-процессуальных инструментов, участником активного судоговорения станет искусственный интеллект. Мы стоим на пороге открытия инновационной во всех отношениях «надлежащей правовой процедуры», в которой место для произвола отдельных субъектов процесса, возможно, удастся свести к разумному минимуму! Впрочем, не будем отрицать очевидного: основные черты этих инновационных процедур все еще в непроницаемом тумане будущего. В то же время никто не отменял азбучного правила: «новую рабочую силу» (следователей, прокуроров, судей и адвокатов) уже давным-давно пора обучать в вузах совершенно по-новому. Высшая школа, а вместе с нею и все общество терпеливо ожидают от академической науки адекватных текущим запросам инновационных учебников по уголовному праву. Нами постоянно подчеркивается мысль, что уголовное судопроизводство — явление суть системное. Для познания данных наук обучающиеся, помимо учебников, обязаны регулярно и системно читать соответствующие юридические журналы, статьи из которых постепенно складываются в монографии, как индивидуальные, так и коллективные. Вниманию читателя предлагается вторая статья из серии. В ней речь пойдет об учебниках по уголовному праву, их месте в системе юридического образования, а также о роли юридической периодики и монографических исследований в познании глубин уголовного судопроизводства.
The acting algorithm of criminal proceedings (understanding the process from a crime to a sentence and the corresponding procedures) is a product of the twentieth century, and in many ways the one of the nineteenth century. At the same time, it is obvious that society has not stood still in its development for these two hundred years. Consequently, new productive forces (means of production) generated new production relations inevitably; primarily, personnel who know the technologies of the nineteenth century. Therefore, it is not surprising, that in the twenty-first century, the "material" offices of police, prosecutor's office and court traditional for the previous centuries, as well as the usual filed "paper" cases are replaced by not just something new, but something absolutely new — innovations: "virtual" office and "virtual" case. Methods to function criminal law and criminal procedure instruments corresponding to the new legal culture will emerge, and artificial intelligence will become a participant in active legal proceedings speaking. We are at the very beginning to open a completely innovative "proper legal procedure", in which the scope for arbitrary action by each subject in the proceedings may be reduced to a reasonable minimum! However, let's not deny the obvious thing: the fundamental features of these innovative procedures are still in the im-penetrable mist of the future. At the same time, the truism remains: it is high time for universities to train the "new work force" (investigators, prosecutors, judges and lawyers) in a completely new way. Higher education institutions, as well as the whole society, patiently expect innovative textbooks on criminal law from academic scholarship that are adequate to existing demands. We constantly emphasize the idea that criminal proceedings are a systemic phenomenon. In order to understand these sciences, it is necessary for students, in addition to textbooks, to read relevant legal journals regularly and systematically, because their articles gradually form monographs, both individual and collective. The author pays the attention of the reader to the second article in the series. It will analyze textbooks on criminal law, their place in the system of legal education, as well as the role of legal periodicals and mono-graphic studies in understanding the depths of criminal proceedings.
