IMPROVEMENT OF THE LEGISLATIVE REGULATION OF CRIMINAL LIABILITY FOR SEVERE VIOLATING TRAFFIC REGULATIONS RULES (ARTICLE 264.2 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION)

Abstract:
The author analyzes the effectiveness of Article 2642 of the Criminal Code of the Russian Federation in fighting traffic violations related to exceeding the speed limit and driving into oncoming traffic lanes or onto oncoming tram tracks, in violation of Traffic Regulations, as well as their consequences. The findings indicate that the mentioned article of the criminal code in its existing form is unable to have a positive impact on fundamental accident rates. The author notes that scope 1 of Article 2642 of the Criminal Code of the Russian Federation does not strictly determine the period to hold a person criminally liable. This fact may lead to significant problems related to determining the public danger of the act committed that contains elements of a crime under the mentioned article of the Criminal Code. Possible variants to solve these problems are proposed.
