CURRENT ISSUES OF FORENSIC INVESTIGATION OF CIVILIAN FIREARMS AND THEIR TRACES ON FIRED BULLETS

Abstract:
The article deals with the problems of legal support for the circulation of civilian firearms, its forensic research. Proposals have been made to bring the sources of regulatory and technical regulation in line with the norms of federal legislation on weapons. It is noted that the reason for the problems was the new approach of the legislator to the definition of the concept of rifled firearms. Based on the study of the designs of civilian models of long-barreled firearms with bore drilling "Lancaster" and "Paradox", cal cartridges. .366 TKM, as well as the analysis of the mechanism of formation of traces of such firearms on fired bullets, revealed the conditions for displaying on them the complex of general and particular signs necessary for the identification of weapons. This is due to the properties of the shells of bullets of cal cartridges. .366 TKM. FMJ bullets with a tompak shell give positive results of displaying traces of the barrel bore on them. Shot lead bullets "DERI" in a polymer antifriction shell do not contain traces of the barrel bore on the leading part of the required quality for identification of weapons. The poor quality of the display of traces on "DERI" bullets is observed both when shooting from rifled firearms with an oval-screw drill "Lancaster" and from weapons with a drill "Paradox". Based on the results of the study, a proposal was made to ban the use of cal cartridges. .366 TKM with a lead bullet "DERI" in a polymer antifriction shell in civilian rifled long-barreled weapons due to non-compliance in these cases with the forensic requirements established by the federal executive authority for the introduction of rifled civilian firearms and cartridges to it.
