The article focused on the difference relation to the results of operational procedure in a view of objectively-veritable and competitive criminal procedure. Objectively-veritable type of process doesn’t allow obliterating distinctions between operational procedure data and criminal evidence, but modern competitive Criminal Code allows it. In a view of objectively-veritable type of process Criminal Code has its form and content. And operational procedure has its form and content as well. Criminal procedure evidence and operational procedure data are important every at its own place. The institution of interaction is important between investigator as a member of criminal process and body of inquiry conducting operational procedure. Scientific views on obliteration of the distinctions between operational procedure data and criminal evidence testify the shortcoming of the competitive criminal procedure (as a result of its separation from real content, objective true).
