The article provides analysis of theoretical and practical problems connected with development of such a method to settle disputes in the legal system of modern Russia as mediation. The author provides comprehensive analysis of peculiarities, features, and elements of the mediation process what represents an important period of studying the essence of the mediation procedure in Russia. Particular attention is given to disputed aspects discussed in legal scientific literature in relation to certain issues of defining the meditative process in the broad and specific sense. Theoretical analysis of the given problem makes it possible to solve a number of practical tasks and give legal evaluation of a number of features characteristic for the meditative process in a modern state. The article reveals controversial issues of Russian meditative process and its legal basis discussed in the legal literature and provides examples from foreign practice experience. At present, the issues of observing citizens’ rights and freedoms have become particularly important in legal activity, thus the problem of mediation is perceived as especially relevant.
