In article the questions concerning the basic characteristics of the right to protection of the person which delivery are considered is requested. The bases of occurrence of the right to protection reveal and the structure of the right to protection of the specified person is analyzed, the characteristic of subject structure and to other features of realisation of the right to protection of the person at delivery for criminal prosecution is given, the most essential lines of the mechanism of realisation of the right to protection of such persons are defined. According to the author, efficiency of realisation of the right to protection of the person, which delivery is requested guaranteed by mechanisms at application of measures of remedial compulsion to the given out person, at decision-making on delivery of the person, its remedial registration and the appeal, by actual transfer of the given out person to the foreign state. The idea about an accessory to the person at all stages of process of delivery of the right to protection is given reason. The conclusion from volume is formulated that absence of appropriate instructions in norms on possibility of the person requested for criminal prosecution and on conditions of their realisation cannot promote realisation of the right to protection of the given person, reducing its efficiency.
