In the legal science the issue of including sanctions in the list of structural elements of the legal rule is usually addressed in the ideological rather than logical manner. The logical basis for including sanctions in the list of structural elements of the legal rule is not established in the legal science or logical-philosophic research. Thus, inclusion of sanctions in the list of structural elements of the legal rule is not admissible. All legal rules have a two-element and not a three-element structure. However it’s wrong to assert that sanctions do not exist. Sanctions do exist but not as a structural element of the legal rule but as a structural element of the system of law. A sanction is an independent two-element legal rule. Also, from ideological point of view we believe that at present it’s not reasonable to exclude state enforcement from the list of legal rule’s characteristics. Due to the existence of sanctions we can’t speak about securing law effectiveness by means of government coercion; we should speak about providing government coercion for breaking law requirements. The connection of sanctions with state enforcement is not objective; it has subjective, volitional character.
