THE NATURE, CONTENT, CHARACTERISTICS AND PRINCIPLES OF POLICY FORMATION

Abstract (English):
The milestone of the new legal-political paradigm is marked with appeared difficulties to understand the fundamentals of theoretical and legal reality. It turns out that most scientists put the concept of «policy» and «law» at the same level emphasizing their interrelationship and interdependence. In the theory of law algorithm of its appearance is thoroughly developed: - if we talk about the legal custom it starts from taboos and prohibitions to their formal involvement in the positive law; - if we talk about the objective reality it starts from the conflict (collision) or gap in law as a factor of the legislative initiative to the official publication. It is surprising that by the present day nobody has thought about the fact of how policy is formed, what stages of this or that social relation exist(s) before it becomes the political one and then turns to politics. In the Russian Federation policy formation is based on the system of principles that represents the set of interconnected elements. This set of basic rules to form and to exist political relations demonstrates (reflects) some objective internal laws of the studied phenomenon functioning. Analysis of the system of the principles of policy formation allows identifying its significance as a concept, determining the algorithm of interaction of the institutions, phenomena, relations that distinguish it from other types of political and legal phenomena.
