В статье анализируется реальное состояние негативного воздействия на интересы правосудия. На основе проведенных социологических исследований делается вывод о повышенном уровне латентности ряда преступлений против правосудия. Отсутствие практики применения норм, регламентирующих уголовную ответственность за данные преступления, неблагоприятно сказывается на эффективности охраны интересов правосудия. Автором рассматриваются причины и условия, которыми обусловлен высокий уровень латентности данных преступлений. Латентность преступлений определяет уверенность виновных в своей безнаказанности, которая, в свою очередь, справедливо считается одним из основных криминогенных факторов, способствующих совершению новых преступлений, посягающих на интересы правосудия. В ходе анализа уголовного законодательства России и правоприменительной практики автором выявлен ряд существующих проблем, предложены возможные варианты их решения.
Real position of the negative impact on the interests of justice is analyzed in the given article. On the basis of the sociological research, the author makes a conclusion related to the increased level of latent state of a number of crimes against justice. The absence of practice to apply rules of law to impose criminal responsibility for these crimes commission affects the effectiveness of the protection of interests of justice in a negative way. The author examines the causes and conditions that determine the high level of latent nature of the analyzed crimes. Latent nature of such crimes gives the involved (and responsible for their commission) persons an opportunity to consider their impunity. For its part the latter is believed to be one of the main factors of criminality to contribute to new crimes commission related to encroachment on the interests of justice. The author identifies a number of topical problems and offers possible variants to solve them, while analyzing criminal legislation in Russia and law enforcement practice.
