В статье рассматривается процесс трансформации некоторых видов объективных ошибок судебного эксперта и следственных ошибок при создании и отборе цифровых объектов. Излагается сложная природа цифрового следа как объекта судебной экспертизы, что требует переработки методики собирания и фиксации такого объекта следователем. Изучаются характеристики современных цифровых объектов, а также средств и устройств, позволяющих их запечатлеть. Рассматриваются проведенные исследования в области «создания» цифрового следа при помощи смартфонов. Приводится количество и модели смартфонов, имеющих в качестве встроенной функции автоматическую ретушь лица. Объясняются недостатки такой функции и потенциальные риски при фотографировании следователями объектов на смартфоны. Предлагаются пути устранения следственных и экспертных ошибок. В частности, представляется целесообразным привлекать по инициативе следователя или эксперта специалиста для участия в процессе отбора и подготовки материалов для экспертного исследования. В качестве одного из способов профилактики следственных и экспертных ошибок предлагается разработка специализированного курса по грамотной работе с цифровыми объектами с его дальнейшим внедрением в образовательный процесс высших учебных заведений в качестве дисциплины для будущих следователей и экспертов.
The article examines the process of transformation of some types of objective errors of a forensic expert and investigative errors in the creation and selection of digital objects. The complex nature of the digital footprint as an object of forensic examination is described, which requires the processing of the methodology for collecting and fixing such an object by the investigator. The characteristics of modern digital objects, as well as the means and devices that allow them to be captured, are being studied. The research conducted in the field of the peculiarities of "creating" a digital footprint using smartphones is considered. Statistics on the number and models of smartphones with automatic face retouching as a built-in function are provided. The disadvantages of such a function and the potential risks when photographing objects by investigators on smartphones are explained. The ways to eliminate investigative and expert errors are proposed. In particular, it seems advisable to involve, on the initiative of an investigator or an expert, a specialist to participate in the process of selecting and preparing materials for expert research. As one of the ways to prevent investigative and expert errors, it is proposed to develop a specialized course on competent work with digital objects with its further introduction into the educational process as a discipline in higher educational institutions for future investigators and experts.
