Статья посвящена изучению практической реализации норм-принципов, содержащихся в законодательстве о контрактной системе РФ. Прежде всего автором выделяются положения, требующие определенных доработок, высказываются предложения по совершенствованию таких норм. В статье проводится анализ правоприменительных актов органов исполнительной власти, уполномоченных осуществлять контрольно-надзорную деятельность в сфере государственных закупок, и на основании этого анализа делаются выводы о степени практической значимости норм-принципов. Автором обобщены основные цели создания контрактной системы в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд, проведен анализ каждого закрепленного в законе принципа их осуществления, дана оценка его эффективности. Статья содержит описание юридической природы контрактной системы, формы ее выражения. Автором высказываются предложения по повышению эффективности обучения кадров, ответственных за закупочную деятельность, и организации контроля процесса закупок. В статье делается вывод о необходимости регламентации исключительных случаев, в которых допустимо ограничение конкуренции при подготовке закупочной документации и проведении процедур закупок.
The article deals with the study of practical implementation of principles and norms within Russian legislation concerning the contract system. The author considers the major provisions that need urgent development and offers solutions for their improvement. The article gives analysis of legal acts regulating control and supervision functions of the executive powers in the field of government and municipal contracts. This analysis allows drawing conclusions about the practical value of these norms and principles. The author summarizes the major goals of contract system as to the purchase of services and goods for providing governmental and municipal needs, and gives a thorough analysis of legal acts that specify the execution of contract system principles, as well as the objective assessment of their effectiveness. The article contains a description of the legal nature of the contract system, the forms of its expression. The author makes suggestions to improve the effectiveness of training staff responsible for procurement and organization of the control of the procurement process. The article concludes on the need to regulate the exceptional cases in which the restriction of competition is acceptable in the preparation of procurement documentation and carrying out procurement procedures.
