В содержании статей, описывающих порядок и основания применения видов наказаний, можно выделить четыре, которые предусмотрены только для военнослужащих: лишение специального, воинского или почетного звания, классного чина и государственных наград; ограничение по военной службе; арест с отбыванием на гауптвахте; содержание в дисциплинарной воинской части. Некоторые наказания, применяемые к общему кругу субъектов, распространяются и на военнослужащих, проходящих службу по призыву или контракту. Обращает на себя внимание тот факт, что такое суровое наказание, как лишение свободы, применяется к военнослужащим на общих основаниях и в исправительных учреждениях, предусмотренных для большинства осужденных. Несмотря на то что уголовно-исполнительное законодательство реализует важный принцип исполнения наказания в порядке разделения осужденных по категориям, в их число не входят осужденные военнослужащие. Поскольку краткосрочная и долгосрочная перспектива создания специализированных тюрем для военнослужащих сегодня отсутствует, следует рассмотреть возможность отбывания наказания в виде лишения свободы названной категории лиц в специальных исправительных учреждениях наряду с другими специальными субъектами (судьями, адвокатами, сотрудниками правоохранительных органов, налоговой инспекции, таможни, судебными приставами, сотрудниками пенитенциарной системы) или дисциплинарных воинских частях.
In contents of articles describing an order and the bases of application of types of punishments it is possible to allocate 4 punishments which are applied only to the military personnel: this deprivation of a special, military or honorary title, cool rank and state awards; restriction on military service; arrest with serving on a guardroom; content in disciplinary military unit. Among the punishments applied to a general circle of subjects, part of them is applied also to the persons undergoing military service or contractual military service. The fact that such severe penalty as imprisonment, is applied to the military personnel in accordance with general practice and in the correctional facilities provided for most of convicts attracts attention. In spite of the fact that the criminal and executive legislation realizes the important principle of execution of the punishment as separation of convicts on categories, the category of the condemned military personnel isn't distinguished. As the short-term and long-term outlook of creation of specialized prisons for the military personnel is absent today, it is necessary to consider the possibility of serving sentence in the form of imprisonment of the called category of persons in special correctional facilities along with other special subjects (judges, lawyers, law enforcement officers, tax authorities, customs, court ushers, employees of a penal system) or in disciplinary military units.
