POLYGRAPH IN CRIMINAL PROCEEDINGS: PROBLEMS AND PROSPECTS TO USE

Abstract:
This article deals with the use of polygraph in the evidentiary process. It examines the historical aspect to use instrumental lie detection methods in criminal proceedings. The article studies the issues for court to admit the evidentiary value of psycho-physiological examinations. Despite the regulatory fixation of this type of examination, attention is paid to the fact that overwhelming majority of courts do not accept its results as evidence in criminal cases. The reasons to form identified judicial practice are also discussed. The arguments presented by scientists and practitioners against the use of polygraph psycho-physiological examination results in evidence process are examined. The author makes a conclusion that some of these arguments have lost their topical nature. Attention is focused on the potential use of the polygraph in evidence process. The significance of the results obtained by polygraph forensic psychological examination for evidence should be assessed by authorized participants in criminal proceedings in each individual case, in combination with other evidence collected in the case. It is proposed to expand the list of types of forensic examinations made exclusively by state forensic organizations to include forensic psycho-physiological examinations by using a polygraph in criminal cases and when verifying crime reports.
