IDENTITY OF THE CRIMINAL AS A SYSTEM-FORMING ELEMENT OF THE CRIMINALISTIC CHARACTERISTICS OF FRAUD ASSOCIATED WITH SOCIAL BENEFITS OBTAINING

Abstract:
In the context of this article, the author analyzes the identifying characteristics of subjects committing frauds associated with social benefits obtaining; consider their most typical signs and features forming a unique socio-psychological portrait necessary for a comprehensive criminalistic assessment of this type of crime. The study: focuses on the classical diagnosis of individual qualities of people prone to commit such crimes that gives an opportunity to identify key aspects to form the identity and its motivation in the aspect of illegal activities related to social benefits; analyzes the basic theoretical approaches, the physiological and social characteristics of the subjects committing this type of crime; identifies six important elements to form the content of criminalistic information related to such subjects of the crime. The analysis of each element is accompanied with examples from archival criminal cases and the results of questionnaires of law enforcement practitioners. In the final part of the work, the author presents a comprehensive socio-psychological portrait of a person prone to make fraud associated with social benefits obtaining (Article 159.2 of the Criminal Code of the Russian Federation).
