Implementation of detective activities by its numerous subjects and persons providing confidential assistance to them is objectively associated with the appearance, turnover and variables of information related to detective forces, means and methods containing official and state secrets. At the same time, in a number of federal laws and departmental regulatory legal acts, there are provisions to govern its turnover in the activities of law enforcement departments in general and subjects of detective activities in particular. Law of the Russian Federation "On State Secret" declares an official legitimate definition of the concept of "state secret" in Art. 1. However, the content of the concept of "secret" (and its varieties) determined by the legislator and departmental creators of regulatory acts in other regulatory legal acts, as well as legal interpretation of the concept made by lawyers and law enforcement agents are not unified and unambiguous (definite). In addition, scientists representing various branches of law have studied the socio-legal phenomenon of "secret" for a long-term period and their results have not lead to the elimination of conflicts in understanding the essence and content of the concept under consideration and its definition. The author attempts to analyze the modern views related to the concept of "secret". These views of scientists and practitioners are considered as a part of the study of the phenomenon of non-publicity in detective activities.
