PROBLEMS TO REALIZE HOOLIGAN INDUCEMENT AS A MOTIVE FOR CRIME IN THE CONTEXT OF NORMS OF THE COMMON PART OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract:
This article: deals with the problems to realize hooligan inducement as a motive for crime in the context of norms of the Common part of the Criminal Code of the Russian Federation; analyzes the properties of circumstances to aggravate the punishment fixed in Art. 63 of the mentioned code; demonstrates the last changes made by the legislator to the specified legal norm. The author: examines hooligan inducement to comply it with the scientifically based criteria for circum-stances to aggravate criminal punishment; researches aspects of the prevalence of the designated motive for criminal behavior, official statistics of crimes committed as a result of hooligan inducement, as well as specific examples of law enforcement practice of courts of general jurisdiction and the Supreme Court of the Russian Federation; touches upon the issue to increase the public danger degree in the presence of hooligan induce-ment in a crime committed; proposes to realize this inducement of a crime in the common part of the criminal law by its introduction in Art. 63 of the Criminal Code of the Russian Federation.
