INTERROGATION TECHNIQUES APPLIED TO THOSE SUSPECTED IN / ACCUSED OF HAVING COMMITTED A CRIME PROVIDED FOR BY ARTICLE 264.1 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract:
Generally investigating crimes related to the persons detained for drunk driving (Art. 264.1 of the Criminal Code of the Russian Federation) is conducted without conflicts, whereas the major challenge for obtaining testimony is memory "gaps" typical for a person while being drunk-driving or driving intoxicated. In order to eliminate the testimony inaccuracies and support traditional forensic techniques, it is recommended to use digital print potential combined with other evidence in the case. However, impeding investigation nevertheless takes place as a typical feature of any case and a way of the accused person's defensive behavior. The effectiveness of tactical techniques application is in direct ratio to the possibility of handling lies and eliciting credible informa-tion in the case. Interrogation tactics should be based on the obviousness of misdemeanor commission. The interrogation tactics offered in the paper generally can't be used as a ready-made model of an interrogator's behavior; they are strongly individual and advisory in nature.
