VIDEO RECORDING APPLICATION AS DIGITAL EVIDENCE IN MODERN CRIMINAL PROCEEDINGS

Abstract:
Digital evidence is getting an essential component of the criminal proceedings in the context of the digitalization of modern society. It can be the key factor in crime detection, establishment of facts, identification of suspects. In this article, various aspects of video recording application as digital evidence in modern criminal proceedings are examined in a comprehensive manner. The digitalization of evidence is assessed as a constantly expanding process, video recording is much appreciated and it has indisputable advantages, particularly impartiality, objectivity, authenticity (for instance, in comparison with other types of evidence). Risks of forgery, data corruption, problems of time detection, location and date of video shooting should be taken into account, while assessing such evidence. The authors conclude that video recording as digital evidence in criminal proceedings is a crucial instrument, which can significantly change the results of investigation and judicial proceedings. In the article, the classifications of video recordings on the basis of different types are analyzed, their procedural and factual particularities, possibilities of application are described taking into consideration the anticipated risks and prospects.
