REPRESENTATIVES OF THE MINISTRY OF THE INTERIOR OF RUSSIA IN THE SYSTEM OF INTERNATIONAL COOPERATION IN CRIMINAL CASES: EXISTING LEGAL ASPECTS

Abstract:
This article analyzes the evolution of the representation institution within the context of international coopera-tion in criminal cases. It considers legal status and functional role of personnel of foreign missions of the Ministry of the Interior of Russia as participants in international law enforcement activities. The base for study is an analysis of international law norms and principles, as well as international treaties, national legislation, and departmental regulatory legal acts of Russia. In particular, the authors analyze legal basis for the activities of mentioned representatives and identify problems related to the legal regulation of their activities in criminal proceedings and detective work. Special attention is paid to their role in international (joint) investigative teams. The authors identify gaps in domestic legislation regarding regulation of the legal status of foreign representatives and officers of the Ministry of the Interior of Russia as participants in international cooperation. The article demonstrates this status to be fixed in international treaties and departmental by-laws. The authors make a conclusion of the importance of foreign missions of the Ministry of the Interior of Russia as a tool for implementing international obligations and improving the effectiveness of cross-border cooperation among law enforcement agencies in criminal cases through the direct information and evidence transfer.
