HISTORY OF DEVELOPMENT AND CURRENT CONDITION OF THE IDEAS OF STATE SOVEREIGNTY

Abstract:
The article explores the evolution of the doctrine of state sovereignty in the context of the development of political and legal thought and modern integration processes. Classical theoretical approaches to understanding sovereignty in the works of N. Machiavelli, J. Bodin, T. Hobbes, J. Locke and J.-J. Rousseau and their influence on the formation of ideas about absolute, popular and limited sovereign power are analysed as well as the concept of H. Kelsen, where sovereignty is considered as a property of legal order and the supremacy of the Constitution. Special attention is paid to the transformation of sovereignty in the context of globalization and the development of international law on the example of the European Union, where a model of functional and delegated sovereignty is being formed. In conclusion, the modern constitutional and legal understanding of sovereignty is analyzed, taking into account the amendments to the Constitution of the Russian Federation in 2020 and their significance for strengthening sovereignty.
