Abstract (English):
The new cassation legislation admits that there can be two ways for a criminal case to pass through the cassation instance court. In the first case, the verification of the court ruling is carried out repeatedly, i.e. consistently at two court instances: in courts at the level of the Russian Federation constituent entities and in judicial divisions of the Russian Federation Supreme Court. In the second case, the court ruling can be verified in an appeal or supervisory manner only, avoiding the cassation instance court. The author offers the solution to this problem.
