The article focuses on the topical theoretical issues of a new structure of the mechanism of judicial discretion when implementing the law-enforcement policy. Special attention is paid to the structure or stages of the judicial discretion mechanism. The following stages of the judicial discretion mechanism are distinguished: 1) establishing the situation when there is no statutory solution of the current legal problem; 2) comprehending the scope of authority within the competence by the subject; 3) searching for a reasonable version of the solution within the limits of the rule of law; 4) making a decision on implementing the competence. The author emphasizes the importance of working out general issues of law-enforcement discretion taking account of the merger of the Supreme Court of the Russian Federation and the Supreme Arbitration Court of the Russian Federation. The article draws attention to some problems and negative aspects of the Russian judicial system operation.
