The article is devoted to comparative legal study of the regulation of the right of participants in criminal proceedings on the statement of motions. This right is an important guarantee of effective implementation by the participants of criminal trial of all other rights. The author revealed defects of legislative techniques and contradictory the normative regulation of the right to statement of appeals in criminal procedure of the Kyrgyz Republic and the Russian Federation. Shown successful options of a regulation of procedure of realization of this important right, proposed his own vision of ways of perfection of norms of the criminal-procedural legislation of the Kyrgyz Republic and the Russian Federation, guaranteeing protection of the rights and legitimate interests of parties to criminal proceedings in part provided by the law of participants in criminal proceedings in the use granting to them right of statement petitions and manifestation of the activity in the criminal process.
