The article covers the ways of commission of frauds with the use of cellular communication, namely scientific and conceptual bases of the way, as the element of the criminalistic characteristic of this type of fraud. Reasonably authors define its key role and the place among other elements which structure the criminalistic characteristic of crimes under consideration. Also the debatable question in criminalistics about structure of the way of commission of crime is brought up. So, on the basis of works of scientists-criminalists the way of commission of fraud with the use of cellular communication is defined as full-structural. In the article the authors` definition of the way of the commission of crime, of the considered category is offered. The authors cover psychological aspect of the swindler’s choice of the way of crime commission. The volume and methods of actions of swindlers at the stages of preparation, commission and fraud concealment are stated, and also the schemes of commission of the most widespread today’s frauds, with the use of cellular communication are described. The authors set forth the contents of each swindling scheme.
