In article, leaning on a methodological design of unity of class and universal components, genesis of formation of the legal category «advantage» is considered. The author the first pays attention of scientific community to value of a subject of legal advantages, not only in a legal key, but also in historical, social, moral aspects. The theoretical importance of work consists in the formulated theoretical provisions and conclusions which develop, correct and specify concepts of legal exceptions, incentives, permissions. Work expands and increases greatly scientific knowledge of advantage as a historical and legal phenomenon, regularities of its emergence and development, conditionality modern realities of public and state life. The practical importance of article which consists in the general orientation on the decision not only theoretical, but also a complex of practical tasks, elimination of problem aspects of fixing and realization of legal advantages can attract attention of lawyers and historians. The reasoned provisions of article, concern optimization of intrinsic and substantial registration of advantages in language of the Russian historical and legal science.
