In the Russian Federation criminal liability for commission of the crimes encroaching on health of the population and public moral, is fixed in chapter 25 of the criminal code of Russian Federation. Inducement to consumption of means and the substances posing threat of health of the population, is the main source of increase in number of the persons consuming dangerous preparations. Article 230 of the criminal code of Russian Federation in the name already establishes responsibility for inducement to consumption of drugs, psychotropic substances or their analogs. The disposition of articles 228.1 and 234 of the criminal code of Russian Federation provides the main the purpose of commission of these crimes - sale, and additional (though directly and not specified in norms) - inducement to consumption of the specified means and substances. Committing these crimes, criminals wish to be enriched at the expense of drug addicts, the size of their income depends on number of the attracted new consumers. The main objective of the crime provided in article 232 of the criminal code of Russian Federation, isn't fixed in article disposition, can be various and qualification doesn't influence. However a holder of a brothel, providing the room, realizes that in it the forbidden preparations will be consumed. Not all subjects, the population hazardous to health found the reflection in considered articles of the Criminal Code of the Russian Federation. According to article 230 of the criminal code of Russian Federation the subjects which are hazardous to health, drugs, psychotropic substances and their analogs are. In reality, at commission of the crimes provided by this article, the specified subjects can be absent. In this connection, it is necessary to make changes to article 230 of the criminal code of Russian Federation, having added in it crime subjects - strong and toxic agents. And in article 232 of the criminal code of Russian Federation - to expand its subject at the expense of the plants containing drugs or psychotropic substances, or their parts, containing drugs or psychotropic substances, strong and toxic agents.
