The article includes analysis of the concept of human rights in terms of philosophy of culture. Based on the history of legal and philosophical doctrines of Russian scientists the authors arrive at the conclusion that human rights in Russia have the underlying value basis of Russian intellectual culture. Under the Russian cultural tradition is understood to be the invariant of various spheres of culture: morality, art, science, politics, law, etc. a Reflection of the Russian cultural tradition speaks Russian philosophy. On the basis of the Orthodox-humanistic paradigm of Russian philosophy of culture was formed ideas about man and his relation to the law in those cultural areas, where they were recognized value. First of all, it is just and moral. The undertaken analysis shows that the human rights issue can not be considered appropriately and settled in the political legal field. Moreover, the restriction of its consideration by this field leads to a distortion of the meaning of personal freedom, to the theoretical confrontation of its various interpretations, which we actually see in the world today.
