The article deals with some theoretical and practical issues of determination of possibility of rights performance and order of exercise of legal rights by foreign citizens legally residing in the territory of Russia according to the technically legal attribute. Unfortunately, nowadays issues regarding residence of foreign citizens in Russia are generally solved by means of constitutional and administrative law. In civil law, as in private one, in general the authors almost do not consider this subject and do not study arising issues by private law methods. Residing in the territory of Russia these people are holders of legal rights, legal obligations, sue and are sued in courts for civil proceedings. However, their individual legal status has not been studied yet in a proper way. Meanwhile, they make bargains, take an active part in economic and other social life of our country. The author makes an attempt to study some issues regarding the legal position of foreign citizens residing in the territory of Russia by scientific methods of inquiry, to determine borders of possible rights performance (legal status), to define individual acquisition and performance of legal rights and fulfillment of legal obligations (legal capacity).
