The implementation of pre-trial agreement on cooperation into the criminal proceedings of Russia has considerably enlarged the powers of the prosecutor, thus defining its significant procedural role in the conclusion and implementation of such pre-trial agreement. The duties and the powers of the prosecutor in application of pre-trial agreement on cooperation are exercised both on pre-trial and trial stages, varying in the extent of rights and means of their implementation. The author of the article analyzes the rights of the prosecutor, theoretical issues of his activities and forms of participation in a criminal investigation and in the adoption of a court decision under a special procedure in cases when it comes to pre-trial agreement on cooperation. Taking into account the requirements of the legal practice the author suggests various legislative solutions for specifying and securing the rights of the prosecutor when it comes to application of the provisions of Chapter 40.1 of the Criminal Procedure Code of the Russian Federation, as well as the possibility of their implementation in the pre-trial and trial stages of criminal proceedings.
