Due to the deterioration in an economic state in Russia the share of crimes in the sphere of crediting has increased. The damage at commission of the acts provided by norms on economic crimes in the sphere of crediting is caused to the concrete bank organizations and often estimated in quite large sums. At the same time articles 176 and 177 of the criminal code of Russian Federation aren't included into the list of the norms specified in the and point of part 1 of article 104.1 of the criminal code of Russian Federation for whose violation it is possible to appoint confiscation of property. Such situation creates a double situation when even at capture of the guilty person the dissatisfied party can't be up to the end confident in compensation of the caused damage. We consider absolutely reasonable a possibility of collecting money from the persons who have committed a crime in the sphere of crediting who considerably would fill up the state budget. For improvement of economic climate of Russia, we suggest to make changes to article 104.1 of the criminal code of Russian Federation, having added the list of norms in the and point of part 1 with articles 176 and 177 of the criminal code of Russian Federation.
