There is a great amount of fires occurring as a result of the fire regulations violation. Committed violations lead to the fire hazard and also can facilitate its quicker burning that causes the gravity of material harm, injury and deaths. The Article 219 of the Criminal Code of the Russian Federation fixes the criminal liability for the fire regulations violation by the person, who is responsible to observe fire regulations as a duty. This article disposition requires the upholding of the fire regulations by the officials and citizens who are responsible for the fire regulations observance. Taken measures help to reduce the amount of fires, material harm, injury and deaths. Law enforcement statistic data show that there are very few numbers of criminal cases and cases presented before the court. The main issue in investigation of such type of crimes is the lack of legal and technical competence of fire crew interrogating officers and investigators of the Internal Affairs Ministry. This competence imperfection demonstrates insufficient theoretical and practical training indispensable in such types of crime investigation. Statistic data of fires and the aftermath of fires in foreign countries don’t much vary in amount and gravity from the analogical statistic data in Russia. Thus, in the USA every five days there are fires with the different gravity degree as a result of the fire regulations violation while providing the works connected with using fire (roofing, electric and gas welding and many others). Along with this, the punishment in the USA for these crimes is much more severe than in Russia although the guilty person doesn’t take part in the fire occurrence.
