The article deals with the correlation of the right to the access to information in criminal proceedings and the principle of publicity. The author concludes that in the acting criminal legislation the principle of publicity takes an extremely «modest» place as the general condition of the criminal proceedings, in spite of its important role in the system of the basic ideas of the democratic criminal proceeding formation. The author considers this fact to be the system error of the developers of the Criminal Procedural Code of the Russian Federation that significantly influences the law-enforcement practice. Thus, the clear regulation of the regime of the preliminary investigation secret is still absent, there are some problems related to providing the participants of the criminal proceedings with the right to the access to information involved in the criminal case materials. The author formulates the proposal to make changes into the acting Criminal Procedural Code of the Russian Federation concerning the following: the publicity must be transformed from the conditions to the principle of the criminal proceedings as well as the special rules of the publicity implementation must be included in the general conditions both of the preliminary investigation and the trial (legal proceedings).
