The article deals with individualization of punishment by means of the criminal and criminal-executive legislation principles. The imposition of punishment is a key phase of law enforcement activities. According to Part 1 of Article 118 of the Russian Federation Constitution justice in our state is administered only by the courts through constitutional, civil, administrative and criminal proceedings. It is the court that has exclusive authority to make final decisions on punishment imposition. At this stage the law enforcer should take into account the whole complex of the criminal rules of law that are relevant while imposing punishment as well as he should ensure the possibility to achieve the goals of punishment. This process cannot be random. It should be based on the legal principles as well as be individually defined and subject to special rules and norms. The aim of the given article is to examine the theoretical and practical problems of individualizing punishment from the point of view of the acting Russia's criminal policy.
