The article deals with the peculiarities of some objective and subjective features of the crimes related to illicit trafficking of narcotics, psychotropic substances or their substitutes as well as narcotic plants. The author of the article examines the particular rules of qualification contained in the explanations of the Plenum of the Supreme Court of the Russian Federation and establishes the degree of correspondence of some of them to the acting criminal legislation. Some types of the appropriate alternative actions are characterized, and depending on their contents the most typical moments of commission of the mentioned crimes are defined. The author proves the possibility to buy narcotics and others without having an intention to sale them in future (in the form of inactivity). The issues on crime participation are examined. In addition, the author offers his own views to solve the issues appearing in law enforcement practice as well as functional algorithms the use of which will reduce the number of mistakes made while qualifying crimes fixed in Art. 228, 228.1, 229 of the Criminal Code of the Russian Federation.
