Constitution of the Russian Federation establishes a set of rights and freedoms of the individual which are said to be the basis of its general legal status. However, legal science has not yet developed a generally accepted approach to determine the correlation of rights and freedoms of the individual. It is known that freedom of the individual can be realized only if the actions, thoughts and feelings of the person are not affected (influenced on) by external factors. In contrast to it, the relevant legal relations appear as the state guarantees the safety, observance and protection of freedoms by means of law. The article deals with one of such spheres of the legal relations - criminal proceedings. As the freedom is derived from law, as well as established and ensured by law, the main role while implementing freedoms of a given participant of the criminal procedure relations is entrusted to other persons who should not prevent it, but fulfill their duties to create conditions for realization of the rights to freedom. Therefore, in the mechanism to guarantee rights and freedoms of the individual in criminal proceedings, it is important to take into account the methods of legislative consolidation of the safety and the protection of rights and the freedoms presupposing specifics of their actual realization.
