The rule of Criminal Law on liability for the illegal business was introduced in the first edition of Criminal Code of the Russian Federation as in force in 1996. During the years Article171 of the Criminal Code of the Russian Federation has been amended and supplemented several times, and its current content differs greatly from its original one. The positive legislation regulating the procedure to implement business (enterprise) activities has been modernized too. Nowadays responsibility for illegal business (enterprise) activities arises in situations to implement non-registered or unlicensed business (enterprise) activities where such license is required. In these article provisions of the Federal Law 129-FZ of the Russian Federation (dated of 08.08.2001) „On the State Registration of Legal Entities and Individual Entrepreneurs“, and the existing theoretical experts’ viewpoints in the field of criminal law are analyzed. An attempt of systematization of the possible options to implement non-registered business (enterprise) activities is made, for which liability according to Article 171 of the Criminal Code of the Russian Federation is provided.
