The article focuses on some peculiarities of international law related to law enforcement at the discretion. Depending on the specific character of international law norms within the legal framework of Russia, the authors determine obvious problems of its influence on such a legal institute as law enforcement discretion. The authors disclose a series of problems connected with the correlation of international law and law enforcement discretion: what decision should be made when there are some contradictions between norms of national and international law, how the law enforcer should apply universally accepted principles of international law, which way the practice of the European Court of Human Rights should be taken into consideration, etc. Law enforcement at the discretion is considered in the context of correlation of international and national legal norms. The authors distinguish two concepts of correlation of international and national law: monistic and pluralistic ones.
