In the article the author, on the basis of a complex analysis, examines the essence and content of the constitutional and legal status of the individual in the dynamics of social relations that form the status of the individual as such. The author comes to a justified conclusion that the constitutional and legal status of the individual, acting as the foundation of the general status, is in this system of norms the most stable, unchangeable and inalienable group of norms. Particular attention is paid to the study of the place and role, as well as the essence and content of institutions of constitutional and general (general legal) personality. The author considers such a dynamic element of legal personality as legal capacity and on the basis of an analysis of existing provisions of the Constitution of the Russian Federation and legislation in the part of the civil service makes a number of legislative proposals aimed at strengthening the effectiveness of state power in Russia.
