The article refers to obligations due to unjust enrichment. Norms about unjust enrichment are contained in the civil legislation of not only Russia, but also many foreign countries. The author made an attempt to conduct a theoretical and legal analysis of the institution of unjust enrichment in Russia and foreign countries, for which the main criteria of this institute were singled out. The peculiarities of the institution of unjust enrichment in foreign countries are that the legislator directs society to maintain moral principles, the importance of conscientious behavior. In the priority is not the external material benefits of everyone, but the inner, spiritual needs of man. Such an analysis allows us to identify shortcomings of the Russian system and to develop the main directions that will contribute to the improvement of the norms of this institution. The signs of unfounded enrichment indicated in the civil legislation of Russia do not allow to distinguish it from other legal relations. This circumstance entails difficulties in distinguishing civil liability from other types of liability. The analysis allows to formulate the working concept of unjust enrichment in the modern legal space, taking into account the importance of indicating the type of property right on which the property is located at the acquirer.
