The article provides a comprehensive analysis of seizure essence as separate investigation activity, drawing attention to tactical, procedural and organizational aspects of seizure execution, observing rights and freedoms of participants in criminal procedure. Reviewed in the article are problems of seizure execution prior to institution of a criminal case and the possibility of seizure execution, tolerating no delay. Identified are actual and legal grounds for seizure execution. Described are errors, made in investigation practice when implementing provisions of article 183 of the Russian Criminal Procedure Code, regarding seizure execution of articles and documents in a house, suggestions are made on adaptation of provisions in articles 165 and. 183 of the Russian Criminal Procedure Code. The purpose of the research is analysis of the existing implementation practice and elaboration of science based recommendations on improving the tactics of this investigation activity. Also raised is the issue of revising the effective Criminal Procedure Code and the necessity in improving articles 183 and 144 of the Russian Criminal Procedure Code.
