Studying contemporary procedural regulation of criminal proceedings’ publicity fixed in Article 241 of the Criminal Procedure Code of the Russian Federation the authors point to the existence of a debate among proceduralists. They believe that on the one hand, it is impossible to have too much publicity, on the other hand, there approaches time for non-regulated publicity, which leads to unlawful limiting the rights of citizens participating in criminal proceedings. Having questioned legality of bringing the principle of criminal proceedings’ publicity just into its condition the authors agree with unacceptability of violating the citizens’ rights. The norms of international and domestic law, the practice of the Constitutional Court of Russia as well as scientific judgments of modern proceduralists have been provided as arguments. At the same time, retrospective analysis of normative regulation for legal proceedings’ publicity in Russia from the 10th to the 17th centuries has been made. It demonstrates in which way publicity, having lost its strength, turned legal proceedings for several centuries into the most closed for the society sphere of state activity.
