The article focuses on the process of development of the category of law enforcement discretion at the pre-revolutionary stage in the Russian state. The authors analyze differences between law enforcement discretion of the given period and up-to-date scientific developments of this legal phenomenon. The connection of law enforcement discretion with legality of the pre-revolutionary period is described in detail. These two phenomena were often opposed to each other instead of being considered by scholars as interactive elements of state regulation. The core of the discretion category in a social sense is the necessity to use subjective personality qualities such as intellectual creativity which can hardly be completely replaced by various regulatory prescriptions.
