TACTICAL ASPECTS OF OVERCOMING COUNTER-SUGGESTION OF SUSPECTS (ACCUSED) IN PRELIMINARY INVESTIGATION

Abstract:
The given article deals with some tactical aspects related to overcoming counter-suggestion mechanisms (counter-suggestion) that certain categories of participants of the criminal proceedings realize subconsciously often, as a rule, those to be suspected or accused of committing criminal offenses. This fact significantly complicates communication between the mentioned persons and the one who is conducting investigation especially in conflict situations. The presence of the latter in most cases, as it is known, is inherent in the process of establishing all the circumstances that are subject to be proved in almost every criminal case. In the theory of criminalistics, it is noted, that between the investigator and certain participants in the criminal proceedings may appear not only semantic but also emotional barriers. Their overcoming is critically important both for establishing effective and sustainable psychological contact and for minimizing the risk of conflict situations to emerge in the preliminary investigation as well as in the interrogation. Obviously overcoming such barriers is extremely important for the investigator's work aimed at solving the problems to face criminal proceedings. The author attempts to consider some tactical features of overcoming various types of protection mecha-nisms by the investigator. These mechanisms are used by the suspect or accused in response to the impact of the investigator's verbal statements.
