THE ESSENCE OF CRIMINAL PROCEDURE TRANSPARENCY AND ITS SYSTEM CHARACTERISTICS

Abstract:
The article regards the essence of criminal procedure transparency and its qualitative characteristics, looks into the ways of transparency influence on the implementation of criminal procedure activity. The author concludes that transparency is interrelated with the matters of achieving the social purpose of criminal procedure, as transparency includes not only the clarity and accountability of activities of competent state agencies and public officials, but also respect to the criminal procedure participants' interests and liberties grounded in basic international standards of human rights, as well as criminal procedure justice ensuring the balance in achieving the personal, social and state interests. Moreover, the essence of criminal procedure transparency is more global in nature, because together with the transparency of justice it involves its other paramount public and legal values, thus, turning into one of the fundamental ideas of this kind of state activity, its "ideological and technological" ground. Making a highly verified transparency model and using it in criminal procedure is likely to transform the whole model of criminal procedure development. The paper also examines the readiness of Russian criminal procedure to implement transparency in terms of computerization, digitalization and digital transformation. Despite the absence of common views upon the essence of these processes in criminal procedure theory, information law and as a result among the law-makers, however, the processes are gradually growing from an "issue under question in science" to still mod-est reality of criminal procedure implementation.
