The article analyzes possible amendments of the fundamental institutions of the Russian criminal law (criminal law and crime) caused to the need to strengthen the protection of the strategic national priorities of Russia in the context of the specifics of the current situation in the country and in the world. It is marked that criminal legislation of the Russian Federation has not been fully codified, while the Federal Law "On the specifics of criminal responsibility of persons involved to participate in a special military operation" dated 24 June, 2023 No. 270-FZ is valid. However, having recognized this law to lose force with the simultane-ous introduction of similar norms into the Criminal Code of the Russian Federation, the legislator demonstrated commitment to the principle of complete codification of criminal legislation. This approach deserves to be sup-ported, while it would be logical to develop an independent chapter on the specifics of criminal liability and pun-ishment for mentioned in this law categories of persons in the General part of the criminal law. According to the author's opinion, increasing application of administrative prejudice in the criminal legislation can "reconcile" it with the idea of a criminal offense: for this purpose it is necessary to recognize the acts with administrative prejudice to be criminal offenses by fixing this norm in the criminal law.
