ISSUES TO INTERPRET CORPUS DELICTI SIGNS PROVIDED FOR BY ARTICLE 258.1 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract:
Analyzing normative legal acts and materials of judicial practice the author presents interpretation of objective and subjective signs of the corpus delicti provided for by article 2581 of the Criminal Code of the Russian Federation. The research considers issues causing difficulties in law enforcement practice related to qualifi-cation of illegal bagging and trafficking of special valuable wild animals and aquatic biological resources belonging to the species listed in the Red Data Book of the Russian Federation and (or) protected by interna-tional treaties of the Russian Federation. The author formulates proposals to differentiate the offences provided for in part 1.1 of article 2581 and paragraph "b" of part 2 of article 2581 of the Criminal Code of the Russian Fed-eration, committed by using information and telecommunication networks (including the Internet). The author doubts the explanation made by the Plenum of the Supreme Court of the Russian Federation in the resolution "On the application of legislation on responsibility for violations in the sphere of environmental protection and nature management by courts" dated October 18, 2012 № 21, related to the characteristics of a person using his official position.
