IMPROVEMENT OF SOME CRIMINAL LEGAL MECHANISMS TO COUNTERACT VIOLATIONS OF TRAFFIC RULES AND USE OF VEHICLES

Abstract (English):
In recent years, transport safety has become one of the key guidelines of the state policy of Russia. Being the most important factor for sustainable social development, increasing the level of protection from road accidents is aimed at saving lives and maintaining health of people. Criminal legal mechanisms play an important role in preventing road injuries. In particular, Article 264 of the Criminal Code of the Russian Federation establishes criminal responsibility for violation of traffic rules or use of vehicles by a person driving a car, tram or other mechanical vehicle. The qualifying characteristics include com-mission of an act: by a person being intoxicated / impaired by alcohol; associated with leaving the scene of its commission; by a person who does not have or is deprived of the right to drive vehicles. The listed circumstances are fixed in the same parts, which indicate an equal degree of their social danger. At the same time, such approach raises law enforcement issues in a number of cases. The purpose of the study is to consider the problems of differentiation of criminal responsibility for violations of traffic rules and use of vehicles as well as to formulate scientifically based proposals to modern-ize criminal legal regulation.
