The article deals with the concept, essence and meaning of the criminal procedure functions by using a system of functional approach. Having examined the points of view existing in the Russian doctrine of criminal procedure, the author justifies the fallacy of defining the function of a participant in criminal proceedings by analyzing his available powers. The author makes a conclusion, that the criminal procedure function should be considered as a line of activity determining the legal status of its subjects. In his article, the author states that in the structure of criminal proceedings criminal procedure functions act as a system-forming component. At the same time, the structure of criminal proceedings is a system of activities of its participants, where each element has its own purpose and specific tasks aimed at meeting the relevant needs of the system as a whole. In the traditional triad of functions (accusation, defense and solution of criminal case), the initial point should be the accusation activating the defense and necessitating the solution of the case. The author concludes that this approach makes it possible: to consider the criminal procedure functions as a structural part of a system of a higher level that is a criminal procedure activity, the last one being an element of crime counteraction in turn is a part of the national security system; and to analyze the place and role of basic criminal procedure functions (prosecution, defense, criminal case solution) in this context.
